Senators DeMint And Ensign Honor Their Oath To The Constitution

Whatever one wants to say about the pantywaists in the republican party (and we all know who they are), put it aside for the moment and ponder two republican senators trying to stop Obamacare on the grounds of constitutionality.  Whenever you have the time available, you may want to send Senators DeMint and Ensign handwritten thank you cards for actually possessing the testicular fortitude to stand up and take their oath to the Constitution seriously. (Unlike Harry Reid who wants to make sure that no future congress will be able to change death panel recommendations.)

Ensign, DeMint to Force Vote on Health Care Bill Unconstitutionality

December 22, 2009 – WASHINGTON, D.C. – Today, U.S. Senators Jim DeMint (R-South Carolina) and John Ensign (R-Nevada), raised a Constitutional Point of Order on the Senate floor against the Democrat health care takeover bill on behalf of the Steering Committee, a caucus of conservative senators. The Senate will vote tomorrow on the bill’s constitutionality.

“I am incredibly concerned that the Democrats’ proposed individual mandate provision takes away too much freedom and choice from Americans across the country,” said Senator Ensign. “As an American, I felt the obligation to stand up for the individual freedom of every citizen to make their own decision on this issue. I don’t believe Congress has the legal authority to force this mandate on its citizens.”

“Forcing every American to purchase a product is absolutely inconsistent with our Constitution and the freedoms our Founding Fathers hoped to protect,” said Senator DeMint. “This is not at all like car insurance, you can choose not to drive but Americans will have no choice whether to buy government-approved insurance. This is nothing more than a bailout and takeover of insurance companies. We’re forcing Americans to buy insurance under penalty of law and then Washington bureaucrats will then dictate what these companies can sell to Americans. This is not liberty, it is tyranny of good intentions by elites in Washington who think they can plan our lives better than we can.”

Americans who fail to buy health insurance, according to the Democrats’ bill, would be subject to financial penalties. The senators believe the bill is unconstitutional because the insurance mandate is not authorized by any of the limited enumerated powers granted to the federal government. The individual mandate also likely violates the “takings” clause of the 5th Amendment.

The Democrats’ healthcare reform bill requires Americans to buy health insurance “whether or not they ever visit a doctor, get a prescription or have an operation.” If an American chooses not to buy health insurance coverage, they will face rapidly increasing taxes that will rise to $750 or 2% of their taxable income, whichever is greater.

The Congressional Budget Office once stated “A mandate requiring all individuals to purchase health insurance would be an unprecedented form of federal action. The government has never required people to buy any good or service as a condition of lawful residence in the United States.”

A legal study by scholars at the nonpartisan Heritage Foundation concluded: “An individual mandate to enter into a contract with or buy a particular product from a private party, with tax penalties to enforce it, is unprecedented– not just in scope but in kind–and unconstitutional as a matter of first principles and under any reasonable reading of judicial precedents.”

  • Diamond I will be sending both Senators a very heart felt thanks, this is one way we all can keep the message out there.

    Also I plan on sending one to Rep. Parker Griffith as well, he should be noticed for his stand and thanked also. Maybe if others from Congress see that we can acknowledge the good we see they will believe that we are serious and will stand up for those that take a stand for us.

    Rep Griffith is a 67 year old radiation oncologist, so I believe that his motives will not be driven by being re-elected, this is a quote from him, “I want to make it perfectly clear that this bill is bad for our doctors. It is bad for our patients. It is bad for young men and woman considering going into health care.”

    Regardless of the actions of these two senators, the Communist takeover of America is going to continue. The forced intergration and amnesty of all of the illegal Mexicans, Cubans, Haitians, Muslims, Somalis and any other group of undesirables will be the next dagger into the heart of America, soon to be followed by abolistion of the 2nd Amendment. History is repeating itself right in front of our eyes, Hitler and Stalin pulled it off many years ago and now Obama, Pelosi, and Reid are creating a new Fascist/ Communist America while we stand around bleeting like a herd of disgruntled sheep. They are stealing our freedoms and our country like thieves in the night not caring about the cost to America or worrying the political consequenses. They have seized the moment and America is theirs. In our haste to avoid confrontation we have gained new Communist masters. 2010 will change nothing, they no longer fear us because they control the election process. I hope our chains rest lightly upon us because America is lost.

    Obviously, we do not value our freedoms enough to stand up and fight for them, so we are getting what we have earned. We will be the generation to bare the shame of allowing the destruction of America by a bunch of of worthless Communist SOBs.

  • Diamond, I will also be sending my thanks to these three gentlemen. I hope many others will also. Their actions deserve our praise.

    What next will we be required by law to purchase whether we have a use for it or not? This criminal act leaves the door wide open for congress to force us to buy any product that they (or their mighty leader) chooses to push.

    What about the unemployed who cannot now buy food and medicine? Is an insurance policy going to feed his family? I think not. We are in dire straits, people, and Thomas Jefferson’s Tree of Liberty may need its measure of blood sooner than we thought.

  • DeMint has been a scalp-taker this week. So that gives us one pit bull in the Senate and one pit bull in the House (Michelle Ma Belle) to build on in 2010.

  • So, the cynic says, what if they vote it is constitutional, by the same margin? While I am glad they are raising it, is this more cover for republicans, so they can say they fought this battle (why now? at the 11th hour?) but lost? Is this also another cover for amending the constitution, like with McCain’s eligibility hearing, without Article V procedures? Desperadoes would appreciate any perspective! 🙂

    I believe they are trying to disguise health care as a “human right” that people have, making the government responsible for all citizens to have a right to health care. Bolderdash! The Dems will throw the Constitution under the bus and try to make a new Constitution for us all, which will include all their mandates. You all better read Saul Alinsky’s Rules for Radicals and you will know what’s going on. It is being follwed to a T. of course that’s my opinion. Isn’t it amazing we should have to thank our Senators for remembering what is in the Constitution and the oath they have taken?
