Source: Justice Souter retiring

WASHINGTON – Justice David Souter is planning to retire after nearly two decades on the Supreme Court, giving President Barack Obama his first chance to fill a vacancy on the high court.

The White House has been told that Souter will retire in June, when the court finishes its work for the summer, a source familiar with his plans said Thursday night. He almost certainly would remain on the bench until a successor is confirmed.

The source spoke to The Associated Press on condition of anonymity because he was not authorized to speak for Souter.

Souter had no comment Thursday night, a Supreme Court spokeswoman said.

Souter’s retirement is unlikely to alter the ideological balance on the closely divided court because Obama is certain to replace the liberal-leaning justice with someone with similar views.

But the vacancy could lead to another woman on the bench to join Justice Ruth Bader Ginsburg, currently the court’s only woman.

At 69, Souter is much younger than either Ginsburg, 76, or Justice John Paul Stevens, 89, the other two liberal justices whose names have been mentioned as possible retirees. Yet those justices have given no indication they intend to retire soon and Ginsburg said she plans to serve into her 80s despite her recent surgery for pancreatic cancer.

Interest groups immediately began gearing up for what could be a grueling battle over a high court vacancy.

“We’re looking for President Obama to choose an eminently qualified candidate who is committed to the core constitutional values, who is committed to justice for all and not just a few,” said Nan Aron, president of the liberal Alliance for Justice.

Some of the names that have been circulating include recently confirmed Solicitor General Elena Kagan; U.S. Appeals Court Judges Sonya Sotomayor, Kim McLane Wardlaw, Sandra Lea Lynch and Diane Pamela Wood; and Leah Ward Sears, chief justice of the Georgia Supreme Court. Men who have been mentioned as potential nominees include Massachusetts Gov. Deval Patrick, Harvard Law professor Cass Sunstein and U.S. District Judge Ruben Castillo of Chicago.

Souter earned his bachelor’s and law degrees from Harvard sandwiched around a stay at Oxford University as a Rhodes scholar.

    I realize we have all signed so many of these things and I do not know how much good it will do but I am working on “the straw that broke the camels back” theory, something at some point is going to make the difference.

  • Can’t say as I blame Souter. If the options are retire or commit suicide, I think I’d retire as well.

    Of course it’s also possible that he just doesn’t want his name to go down in history as part of the Court that destroyed the Republic. I’m betting on my first set of choices, though.

    I wouldn’t be surprised if it is Devel Patrick. After all, he and Obama (cue in Patty Duke song) they…look alike and talk alike and times they even walk alike, they’re a crazy pair!

    You all may be tired of hearing me say it but we REALLY need to get this bozo and his corrupt gang out of OUR oval office as soon as possible! They are doing crap faster than we can say Jack Robinson and most of the population isn ‘t even aware of it all. I know my family aren’t. They won’t even listen to me. They’ll be shocked when the painters come to their doors!
    We need a hugh tea party to get him out and we need to do it very soon!!

I noted today that Chavez had his police subdue demonstrating crowds with tear gas and fire hoses, so be prepared as you go forth this summer to make your voices heard. I hear it’s illegal to own a tear gas mask but…maybe that’ll change? LMAO, j/k there folks, we know better than to believe anything to protect Americans would be legal.

  • Mary Ellen, I think it’s been Deval all along. He was the “Plan B” in case BOzo was somehow neutralized, rendered unfit or otherwise knocked out of the box before they could install him. You can get the ranch he’s in there thick as a thief.

  • w/r/t Souter: He came VERY close to resigning in 2000 after the SCOTUS’ Bush coup. I imagine he has simply seen more than he can stand at this point. I rather doubt he has been threatened–if anyone were going to be threatened it would have been Alito, Scalia, Roberts or Thomas. Hey, who knows, maybe they already HAVE been…after all, we don’t see them jumping on the chance to preserve and protect our Constitution by hearing any of the cases asking to clarify BOzo’s eligibility…sadly, they were my last hope, and it appears that they, too, have been co-opted, corrupted or just plain frightened. Maybe those two ACORN idiots that came to my hood paid visits to them too. Sigh.

    Because the MSM said that although he liked his job, he disliked washington, I decided that it probably was at best partially true. If you like your job as much as you say you do, it’s unlikely that the place where you do it has that much bearing. They want him out of the way? IF so, why? Then there’s the other thing, like the rats leaving sinking ship rule. And my brother said to me, you know, most of the time, the best place to stand when the shit hits the fan, is not right out in front. Ah- maybe Souter knows something we don’t?

    Kathy, that article was brilliant. Why do we have to go to the UK to get it? What the hell is the matter with the journalists in this country. This scoop is huge! But they have heads filled with Kapok, and decided instead the A/H1N1 thing was more important. Mean while, the Taliban is like ][ this close to taking over in Pakistan, and we know they have already vowed to destroy us. If they manage a coup, they will have that capability. Hillary Clinton was absolutely right for once; meanwhile, back at the ranch, the boys and girls in Washington are bickering about what to do! They are not working together, they are bickering while we’re going to be staring into the muzzle of an ICBM if this isn’t stopped. NO, the taliban is NOT interested in their own playground! They already consider the government in Islamabad to be illegitimate and they are not going to stop until it’s overthrown. Big ASSED mistake to let them develop nuclear weapons, wasn’t it?

    I post the rest of what I wanted to say:

    Keep an EYE on the taliban/pakistani thing because it’s a perfect set-up if you want to demonstrate that NWO the only way to control a turbulent world. And I just thought it was pretty irritating that while all this is going on, it seems the Obama court doesn’t know what they are doing.
